HOOVER, AL (WBRC) -

Police have filed a new charge against a Hoover man arrested and already charged with misdemeanor DUI in a wreck between his pick-up truck and a school bus.

Police say William Churchill McCarty, 50, has been charged with a first degree assault in the accident. The original charge was upgraded following the reconstruction of the accident scene which determined the speed of the vehicles as well as other details.

The accident occurred just before 8 a.m. Tuesday, Jan. 17 on Sulphur Springs Road and Marywood Lane, according to Hoover Police Captain Jim Coker.

The driver of the school bus was transported to a local hospital with non life-threatening injuries and one child was transferred to Children's with non life-threatening injuries.

Captain Coker said the day of the accident that McCarty was arrested because "he appears to be under the influence." McCarty is currently in custody of the Hoover Jail.

A witness to the accident, Kelly Jackson of McCalla, says he followed the driver of the pick-up truck from a gas station after calling 911 to report an intoxicated driver. Jackson said the 911 dispatcher told him not to interfere but to follow the truck to give police a location. Jackson says the driver swerved numerous times and crossed the double yellow lines before hitting the school bus head-on.
