Weaver mayor case ends in mistrial

CALHOUN COUNTY, AL (WBRC) -

A civil lawsuit against the mayor of Weavor has ended in a mistrial due to a hung jury.

The trial was held to determine whether Mayor Garry Bearden was qualified to serve as mayor since he owns two homes, one in Anniston and one in Weaver. If the court ruled that Bearden's primary residence was his Anniston home, Bearden wouldn't meet the requirements to serve as mayor of Weaver.

The jury could not come to a unanimous decision in the case and split 10-2 in favor of the mayor.

There will be a second trial at some point in the future but Calhoun County Circuit Judge Malcolm Street has not yet determined the date.
