BIRMINGHAM, AL (WBRC) -
Birmingham police say a Tuesday shooting was a justifiable homicide.
28-year-old Johnta Tate was shot to death on the 500 block of 18th Street Ensley. Detectives say he was killed during the course of a robbery.
The suspect who was taken into custody was released and will not be charged.
