BIRMINGHAM, AL (WBRC) -

A man accused of stealing nearly $100,000 from the Alabama Theatre faced a judge for a preliminary hearing a couple on Tuesday.

Jeffrey Kizziah is the former technical director at the Alabama Theatre. He showed up for the preliminary hearing but did not speak to the judge. Instead, his attorney and a prosecutor approached the bench. They told the judge they agreed the theft happened, but both parties disagree on the amount taken and how it happened.

Court records show Kizziah is accused of taking about $97,000. He is charged with first degree theft and is out of jail on $30,000 bond.

Kizziah's attorney wanted to enter a blind plea - a guilty plea even though there is no plea agreement in place. That did not happen because the judge had to be somewhere. She rescheduled the preliminary hearing for January 16th at 10 a.m.
