Man indicted in fatal accident that killed his wife

TUSCALOOSA COUNTY, AL (WBRC) -

A grand jury has indicted a man in connection with a fatal wreck that killed his wife and injured five others.

The crash happened on Gainsville Road in Tuscaloosa County in April of this year. Marcus Wilder lost his wife Misty Smith in that crash and his 4-year-old son was severely injured.

Wilder was arrested Monday on manslaughter charges. A grand jury heard evidence in the case in October and indicted him on not only those charges but also assault and vehicular homicide.

Wilder is suspected of hitting another car head on. That other car was driven by a woman who had three children as passengers. They suffered minor injuries.

Tuscaloosa County DA Tommy Smith, who is not related to Wilder's wife, says the grand jury determined Wilder's driving caused the death of his wife and injuries to his son and others.

"Then there were four other people in another car…injured, although not as severe, those are the victims in the case. And the law looks to see what probable cause exists to charge anyone. In this case, the grand jury felt there was sufficient evidence to show that," Smith said.

If convicted Wilder faces up to 25 years in prison.
