BIRMINGHAM, AL (WBRC) -

A murder suspect appeared in court Tuesday, accused of firing gunshots that killed a mother while she held her newborn.

According to today's proceedings, there are at least four witnesses who have identified Corderious McLellan as the shooter in this case.

Police say they have three separate pieces of video that show the shooting as it happened.

Twenty-eight-year-old Sherri Williams was killed while standing in the doorway of her Gate City apartment. She was holding her 10-day-old son when the bullet hit her in the chest.

She and a neighbor were talking as a fight broke out between two girls at the neighborhood store about 325 feet from Williams' apartment.

Williams' brother, Tori, told police he was there watching that fight when a guy walked towards and tried to pick a fight with him. Tori Williams walked away from the confrontation and as he did so, witnesses say McLellan pulled out a gun and started shooting at Williams.

But the bullet meant for Tori Williams ended up hitting his sister Sherri instead.

It is still unclear why McLellan was aiming for Tori Williams because the men apparently did not know each other.

McLellan's attorney argues his client should be charged with murder, not capital murder because he did not intentionally fire inside Sherri Williams' apartment.

However the judge used case law to confirm the capital murder charge. He bound the case over to the grand jury and denied McLellan a bond.
