Jeffco DA: Surviving burglary suspect to be charged with felony murder

BIRMINGHAM, AL (WBRC) -

The Birmingham Police Department reported on Friday that the survivor of a double shooting will be charged with felony murder in connection to his accomplice's death.

25-year-old Devery Bell was shot and killed on September 14 after allegedly burglarizing an apartment at 737 Barcelona Court along with 25-year-old Michael Jones. Jones was also shot and injured in the incident.

The Jefferson County District Attorney's Office says a felony murder warrant has been obtained against Jones, because "he initiated the circumstances that led to the victim's death as both suspects/shooting victims attempted to burglarize the resident's apartment."

Investigators were advised to not file charges against the resident of the apartment since Bell and Jones were believed to be committing a crime during the shooting. The District Attorney's Office says the shooting was justifiable.

"It's obvious that this senseless burglary act created an even larger danger to all who were involved. The ultimate consequences of the suspects' reckless behavior affected them and each of their families. There truly are no winners in this case," said Birmingham Police Chief A.C. Roper.
