Advanced Disposal is not giving up its fight to prevent Deep South Sanitation from collecting trash in Lowndes County.
Advanced Disposal recently filed an appeal of a judge's December 2nd ruling in the case.
The ruling allowed Deep South Sanitation to continue collecting trash even though the county had a contract with Advanced Disposal saying that Advanced Disposal was the only company allowed to collect trash in Lowndes County.
"[This appeal] is very significant to Deep South," said Rob Plumb, attorney for Deep South Sanitation.
"The county and their business partner are challenging that ruling, I guess with the ultimate goal of reversing it. The effect of which would be to put Deep South out of business," Plumb continued.
The case will now go to the Georgia Supreme Court and a decision will likely be made sometime in the next nine to twelve months.
"As a practical matter," Plumb said, "the state Supreme Court would be the final decision maker. Either party could file a petition to have the case heard by the U.S. Supreme Court, but they only hear a very small percentage of the cases that people try to take up."
In the mean time, Deep South will continue to operate as usual.
