ETOWAH COUNTY, AL (WBRC) -

An Etowah County capital murder suspect is out of jail after pleading guilty to manslaughter in the death of her daughter.

Tonya Cate, 39, has been in jail since 2005 on a capital murder indictment for the death of her 16-month-old adopted daughter.

After years of delays, Cate was finally scheduled to go on trial this week. But attorneys on both sides say after "new evidence" came to light, Cate pleaded guilty to manslaughter and was sentenced to prison.

Cate was then released based on time served. She will be on unsupervised probation for two more years.
