A witness who originally identified Justin Jones as the person who shot Jermaine Walton at Railroad Park has changed his story, according to Jones' attorney.
Walton, 15, was found suffering from a gunshot wound at the park on March 17, 2013 and died the next day from his injury.
Justin Jones, 18, was charged with Walton's murder in late April 2013.
Jones' attorney, Charles Salvagio, says a key witness recanted the story to Jones's grandfather, cousin and to Salvagio himself.
Salvagio has filed for a motion asking Judge Clyde Jones to have the case dismissed against his client.
Judge Jones has scheduled a hearing on the motion in May.
